License Terms

This license agreement ("License") is between Fungibility LLC, a Florida limited liability company ("Licensor"), and you, the purchaser ("Licensee"). By purchasing and downloading any music pack from erosound.com, you agree to be bound by the following terms. If you do not agree, do not download or use the Tracks.

1. Grant of License

Licensor grants Licensee a perpetual, non-exclusive, worldwide, non-transferable license to use the purchased audio files ("Tracks") in any number of projects, including but not limited to: content published on OnlyFans, Fansly, Chaturbate, ManyVids, Clips4Sale, cam streaming platforms, boudoir photography, pole dance performances and recitals, wellness and intimacy coaching content, and any other audio-visual work regardless of content rating. This license covers both commercial and non-commercial use. Monetization of content containing the Tracks, including paywalled and subscription-based content, is permitted without restriction. No attribution or credit to the Licensor is required. This license is perpetual and irrevocable, subject only to the termination provisions in Section 6. The license remains valid even if the Licensor ceases operations.

2. Explicit Adult Content

This license explicitly permits the use of Tracks in adult and sexually explicit content. There are no content rating restrictions on how Licensee uses the Tracks in creative work, provided such use is legal in the jurisdiction where the content is created and distributed.

3. Permitted Modifications

Licensee may edit, loop, layer, remix, pitch-shift, time-stretch, or otherwise modify the Tracks for use in their projects. The resulting work must incorporate the Tracks as part of a larger production. Isolated remixes or derivative works intended for standalone music distribution are not permitted.

4. Restrictions

Licensee may NOT: (a) redistribute, resell, sublicense, gift, or share the raw audio files or download links with any third party; (b) claim authorship or ownership of the Tracks themselves; (c) upload the Tracks to any music distribution service (Spotify, Apple Music, Amazon Music, Tidal, etc.) as a standalone release or as part of a compilation album; (d) include the Tracks in a competing music library, stock music service, or licensing platform; (e) use the Tracks to train, fine-tune, or develop any artificial intelligence or machine learning model, including but not limited to music generation systems; (f) share, publish, or transfer download links provided at the time of purchase. Each download link is for the sole use of the original purchaser.

5. Age Requirement

By purchasing from erosound.com, Licensee confirms they are at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. This license is void if the Licensee does not meet this age requirement.

6. Termination and Revocation

This license is automatically and immediately revoked, without notice, if: (a) Licensee breaches any term of this agreement, including the restrictions in Section 4; (b) the Tracks are used in connection with any activity that is illegal under applicable law, including but not limited to the commission of a crime, creation of illegal content (such as content involving minors, non-consensual acts, or trafficking), fraud, harassment, defamation, or the infringement of third-party rights; (c) the Tracks are used in content that promotes violence, terrorism, or hatred against any individual or group. Upon revocation, Licensee must immediately cease all use of the Tracks and remove them from any published works.

7. Copyright and Content ID

Licensor does not register Tracks with any content identification system. Licensee will not receive copyright claims from Licensor.

8. Privacy

Licensor processes payments through self-hosted cryptocurrency infrastructure. Purchase information is not shared with any third party. The only personal information collected is the email address provided by Licensee for download delivery.

9. Indemnification

Licensee agrees to indemnify, defend, and hold harmless Licensor, its owners, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to Licensee's use of the Tracks, including any breach of this License or any claim that Licensee's use of the Tracks caused harm to a third party.

10. Disclaimer of Warranties

The Tracks are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Licensor does not warrant that the Tracks will be free from defects or errors, or that their use will be uninterrupted.

11. Limitation of Liability

In no event shall Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to this License or the use of the Tracks, regardless of the theory of liability. Licensor's total aggregate liability under this License shall not exceed the amount paid by Licensee for the applicable music pack.

12. Refunds

Due to the digital nature of the product, refunds are not available once the download link has been accessed.

13. Governing Law

This License shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. Any disputes arising under this License shall be resolved in the courts of St. Johns County, Florida.

14. Entire Agreement

This License constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, or representations. Licensor reserves the right to update these terms for future purchases; however, the terms in effect at the time of purchase will govern that purchase in perpetuity.
